What are Charlotte's Airbnb Laws?

Charlotte’s city council hasn’t been as fast to place restrictions and regulations on short term rentals as other major cities across the U.S. For a major city, Charlotte is about as relaxed as it comes in terms of placing regulations on Airbnb operations. Adoption isn’t out of the question in the near future though, as the issue is arising in cities close to home like Asheville and the Raleigh/Durham area. New committees being formed for the purpose of investigating and proposing laws that impact the short term rental industry.

While there aren't major regulations impacting short-term rentals, there are still some legalities you should pay attention to when deciding to host on Airbnb. Here’s an overview of some of the laws and ordinances that can impact Airbnb hosts in Charlotte:

Charlotte Zoning Ordinance

-You can find local zoning regulations in Appendix A of Charlotte’s Code of Ordinances

-Check zoning regulations at the location of your property

-Uses permitted will depend on the property’s classifications i.e. single family home, multifamily district, urban residential, institutional, etc.

Building License and Tax

-Charlotte regulates that any businesses operating in city zones must operate with a license

-Business Link North Carolina can provide you with proper information and resources on what license or permit you might need to operate your Airbnb in it’s proper zone

-Contact local operational boards and determine how to register your Airbnb business with the state

Building and Housing Standards

-Room Occupancy Tax and Sales Tax must be paid by property owners who rent accommodations for more than 15 days out of the year

-Airbnb is already in agreement to collect and remit local taxes on behalf of hosts in Charlotte, NC

Other

-HOA and condo associations sometimes have declaration language that prohibits or restricts short-term rentals
